Riverside Terrace II LP, Sanford Health Network North dba Sanford Medical Center Thief River Falls, Dartmoor Corporation, Clark Oil & Refining Corporation nka Clark Brands, LLC, the City of Thief River Falls; the unknown heirs of any of the above-named Defendants; and all persons unknown
claiming any interest, right, title, estate, lien, encumbrance or claim in the real estate described in this Complaint,
Defendants.
THE STATE OF MINNESOTA TO THE ABOVE NAMED DEFENDANTS:
You, and each of you, are hereby summoned and required to serve upon Plaintiffs’ attorneys an answer to the Complaint which is on file in the office of the Court Administrator of the above named Court, within twenty (20) days after the service of this Summons upon you, exclusive of the day of such service.
If you fail to do so, judgment by default will be taken against you for the relief demanded in the Complaint.
You are further advised that this is an action to determine adverse claims to the following described real estate, situated in the County of Pennington, State of Minnesota, to-wit:
PROPOSED LEGAL DESCRIPTION TRACT A WHICH IS OWNED BY EASTDALE, LLC
That part of Lots 8, 9, 10, 11, 12 and 13, and that part of the vacated alley adjoining said lots, all in Block 2 of Porter’s Addition to the City of Thief River Falls, Pennington County, Minnesota, described as follows:
Beginning at the northwest corner of said Lot 13, Block 2, Porter’s Addition; thence North 90 degrees 00 minutes 00 seconds East, assumed bearing, along the north line of said Lot 13, a distance of 82.60 feet to the southwesterly line of that tract of land conveyed by Warranty Deed recorded as Document No. 197518 in the office of the Pennington County Recorder; thence southeasterly, along said southwesterly line of said tract of land conveyed by Document No. 197518, a distance 88.21 feet, along a non-tangential curve concave to the southwest, radius of 372.50 feet, chord bearing of South 56 degrees 02 minutes 07 seconds East, chord distance of 88.00 feet; thence South 00 degrees 17 minutes 36 seconds West, a distance of 108.24 feet to the northerly right-of-way line of Labree Avenue as platted in said Porter’s Addition; thence westerly, along said northerly right-of-way line, a distance of 111.23 feet, along a non-tangential curve concave to the north, radius of 216.30 feet, chord bearing of South 84 degrees 46 minutes 09 seconds West, chord distance of 110.01 feet; thence westerly, along said northerly right-of-way line, a distance of 45.66 feet, along a reverse curve, concave to the south, radius of 150.14 feet, chord bearing of North 89 degrees 17 minutes 28 seconds West, chord distance of 45.48 feet, to the southwest corner of Lot 8, Block 2 of said Porter’s Addition; thence North 00 degrees 00 minutes 00 seconds East, along the west line of said Lots 8, 9, 10, 11, 12, and 13, a distance of 166.87 feet, more or less, to the point of beginning.
Said tract of land contains 24,276 square feet, more or less.
PROPOSED LEGAL DESCRIPTION TRACT B WHICH IS OWNED BY PENNINGTON SQUARE, INC.
That part of Lots 5, 6, & 7 and that part of vacated alley adjoining said lots, all in Block 2 of Porter’s Addition to the City of Thief River Falls, Pennington County, Minnesota, described as follows:
Commencing at the northwest corner of said Lot 13, Block 2, Porter’s Addition; thence North 90 degrees 00 minutes 00 seconds East, assumed bearing, along the north line of said Lot 13, a distance of 82.60 feet to the southwesterly line of that tract of land conveyed by Warranty Deed recorded as Document No. 197518 in the office of the Pennington County Recorder; thence southeasterly, along said southwesterly line of said tract of land conveyed by Document No. 197518, a distance 88.21 feet along a non-tangential curve concave to the southwest, radius of 372.50 feet, chord bearing of South 56 degrees 02 minutes 07 seconds East, chord distance of 88.00 feet to the point of beginning of that tract of land to be described herein; thence South 00 degrees 17 minutes 36 seconds West, a distance of 108.24 feet to the northerly right-of-way line of Labree Avenue as platted in said Porter’s Addition; thence northeasterly, along said northerly right-of-way line, a distance of 74.65 feet, along a non-tangential curve to the northwest, radius of 216.30 feet, chord bearing of North 60 degrees 03 minutes 33 seconds East, chord distance of 74.28 feet, to said southwesterly line of that tract of land conveyed by Document No. 197518 ; thence northwesterly, along said southwesterly line of that tract of land conveyed by Document No. 197518, a distance of 95.85 feet , more or less, along a non-tangential curve concave to the southwest, radius of 372.50 feet, chord bearing of North 41 degrees 52 minutes 48 seconds West, chord distance of 95.59 feet to the point of beginning.
Said tract of land contains 3,828 square feet, more or less.
